Even though retirement plans must be established with the intention of being “permanent,” an employer can generally terminate a plan at any time.  To make sure the plan remains qualified, however, certain requirements must be met.  In this NIPA webcast, David Schultz will review the steps, how-to’s and timeline of terminating a defined contribution plan, including:
  • Selecting a termination date
  • Updating plan documents
  • Fully vesting participants
  • Notifying participants
  • Whether to submit the plan to the IRS for approval
  • Handling benefit calculations, distributions and tax payments
  • How to deal with unexpected situations (lost participants, unallocated forfeitures and investment income received after final distributions are paid)
  • Mid-year terminations of safe harbor 401(k) plans
  • Determining if a partial plan terminations has occurred
