IRS 401(k) Questionnaire and Its Impact on Future Compliance

The IRS recently sent out 1,200 Questionnaires to employers sponsoring 401(k) plans trying to determine where compliance deficiencies exist. Employers are nearing the end of the response period. Hear a practitioner perspective about what is involved in completing the questionnaire and where inadvertent issues may lurk. More importantly, the IRS intends to use what it learns from the Questionnaire as the basis of future exams. Now is the time to look at the issues raised by the questionnaire and work with clients to conduct self-audits before the IRS comes knocking at the door.

403(b) Update

This 100 minute interactive course is intended to provide practitioners with an in-depth look at a variety of 403(b) issues. We will cover the DOL Field Assistance Bulletin trilogy, i.e. FAB 2007-02, 2009-02 and 2010-01 which together provide significant guidance on a number of 403(b) issues. We will examine the 403(b) document remedial amendment period for existing 403(b) arrangements that adopted a written plan document by December 31, 2009 and for brand new 403(b) arrangements opened after December 31, 2009. We will cover the status of the prototype plan document program and existing plans adopting a prototype document versus a volume submitter. Finally, we will cover any other new guidance that occurs by the time the class is offered. It is expected that the new EPCRS will have a non-amender procedure for 403(b) plans that did not adopt a written plan by December 31, 2009. There are also some intricate plan design issues we will discuss The information provided is practical and you can put it to use immediately to establish more effective administrative procedures and reduced compliance issues.
Safe Harbor 401(k)s: Design and Correction

New Roth Conversion and Portability

This eSeminar focuses on the TIPRA changes permitting a conversion to a Roth IRA as of 2010, which brings a new opportunity for those who were precluded from making this transaction by the AGI limit in effect prior to 2010. TIPRA also offers a special two-year tax deferral treatment, but only for Roth conversions occurring in 2010. This new option will benefit many who were not eligible to convert to a Roth IRA before 1010. Further, the removal of the AGI limit on conversions permits those not eligible for a Roth IRA to contribute to another retirement vehicle and convert it to a Roth by rollover, as there is not AGI limit on rollovers.
